South Africa accuses Israel of violating the 1948 UN Convention on the Prevention and Punishment of Genocide.

The Republic of South Africa appealed to the UN International Court of Justice for violating the 1948 UN Convention on the Prevention and Punishment of Genocide with its actions in the Gaza Strip since October 7.

In a written statement, the International Court of Justice stated that the JAR filed the application based on Israel's violation of its obligations under the Genocide Convention against the Palestinians in the Gaza Strip.

The statement said the JAR is seeking an injunction against Israel "since October 7, 2023, for its failure to prevent genocide and its direct and overt incitement to genocide."

"Israel's actions and inactions constitute genocide because they were committed with the express purpose of committing genocide," the statement said. It is noted that the actions carried out are aimed at "destroying the Palestinians in Gaza".

"The Government of Israel, through government officials and other individuals and entities at the direction, commission, control or influence of government officials and others, is in violation of its obligations under the Genocide Convention by its actions against Palestinians in Gaza," the statement said.

JAR is based on Article 9 of the Genocide Convention

According to Article 9 of the Convention on Genocide, in case of violation of the articles of the Convention by the state, any state party to the Convention can apply to the international court with a claim against the violating state.

If absolutely necessary, the International Court of Justice can issue a temporary injunction to stop violations pending the conclusion of the proceedings.

Earlier, on November 11, 2019, the Gambia applied to the International Court of Justice to investigate the genocide of Rohingya Muslims on behalf of the Organization of Islamic Cooperation.
