WHO DESERVES A BAN?
The difference between the Islamic legal system and other systems is that its method is based on the knowledge of God, the Absolute Knower. That is, the guidance given by Allah, the possessor of all knowledge, who is extremely wise, is without a doubt wrong and beneficial.
Other legal systems may be based on different things, for example, tradition, the order of the monarch, the vote of the deputies, the will of the head of state.
The preamble of the Constitution of the Republic of Uzbekistan shows the principles on which the legislation of the country is based. In the Law on Regulatory Legal Documents, scientificity is listed among the main principles.
That is, any laws and regulations adopted in Uzbekistan are required to be scientifically based. In fact, only laws based on the results of scientific research can bring real benefit to society, "hurra-ura" or some official's "bosaver, I'll answer!" Actions carried out at the request of this can lead to disastrous consequences in real life.
In the recent past, we have witnessed the problems caused by one of such draft laws presented without scientific basis. At that time, President Shavkat Mirziyoyev addressed the deputies after the riots in Karakalpakstan regarding the articles in the draft constitution: "My objection is that you are the leader, you took the initiative, you signed, you spoke, and you approved. I am always open! Why didn't you call me, people are dissatisfied, etc.... Who needs to shame our hard work!" he reacted.
In fact, the initiatives of some law initiators without thinking, without scientific study of the situation, and without calculating the consequences, created a great danger in our country.
If, at that time, the deputies and initiators of the law proposed the will of the population in a real scientific manner, relying on appropriate research methods of such disciplines as sociology, political science, and psychology, such a big problem would have been avoided.
Even today, executive bodies brought to the attention of deputies a proposal to prohibit and punish the study of our religious concepts, which are the basis of our national values guaranteed by our Constitution.
How much this proposal relied on scientificity, which is the main principle of regulatory legal documents. Who can guarantee that this proposal is not made based on the principle of "let the mother suckle the mother" and perhaps it is based on the wishes and interests of our people?
Have we learned from our children the consequences of limiting our religious concepts, which are the foundation of science, the foundation of humanity, and the origin of our nature? Has it been analyzed whether this proposal will cause any kind of dissatisfaction, inconvenience, or, God forbid, bigger problems in the society in the future?
How many innocent, patriotic and promising young people have already paid fines and left their country because of the wrong execution of the decision on the examination of religious materials, which was taken without deep thought? How many people have been turned into innocent criminals by the response, "we know there's nothing wrong with your stuff, but the law needs to work"?
Not only the prohibitions for children, but also for adults to receive religious education in the country, actually caused thousands of children of our country to wander in countries like Egypt and Turkey. Which child who has received education in his country goes abroad?
Can't our powerful country provide ten or twenty thousand citizens with quality, controlled religious education free from various destructive ideas? Or do the supervisory organizations not have the potential for this?
Shouldn't he be allowed to regulate the gambling sector, which is causing the biggest social problems in our society today, has ruined hundreds of thousands of families, and hanged the necks of thousands of young people? It is being given.
Why don't we allow him to regulate the chaotic religious education?
In general, when it comes to what should be banned and who should be punished, I would say that I should introduce legislation without scientific justification. I would say the officials who made such a proposal and the deputies who voted for it. After all, they themselves are the leaders, they take the initiative, they put their hands on it, they speak out and confirm it themselves! They themselves are the cause of chaos, disorder, chaos and discontent in society! Shouldn't they be responsible? Don't these actions deserve to be banned?
