Refutation to the Turkish Migration Agency (Göç ıdaresi) regarding the arrest of Mubashşir Ahmed


Turkish lawyer Ibrahim Ergin X has issued a rebuttal on social media to the statement of the Turkish Migration Board (Göç ıdaresi) regarding public objections to the arrest of Ustad Mubashshir Ahmed in Istanbul and his transfer to the Uzbek government. We are bringing this rebuttal to your attention by translating it in full into Uzbek.

The statement issued by the Migration Service stated that the decision to deport teacher Alisher Tursunov was made due to the fact that he posed a threat to public order and security. However, it is clear that this claim is not based on any legal and concrete basis from either the competent authorities of the Republic of Turkey or the international community. The respected teacher has not committed any actions that violate public order or security, nor has there been any evidence that he has committed a crime in Turkey, Uzbekistan, or any other country. It should be clearly noted that this process was initiated solely under the influence of information sent by the Uzbek authorities that was of an informative nature and did not have a legal basis. In this regard, there is no indication that the relevant decision on deportation was assessed within the framework of the principles and grounds set out in Articles 4 and 55 of the Law No. 6458 “On Foreigners and International Protection”. The negative responses to our appeals on this issue indicate that the legal control procedure has not been implemented.

Teacher Alisher Tursunov was previously taken from his home on 28.12.2023, having arrived from Uzbekistan and subsequently being taken away from his home due to a criminal charge that was later dropped. On that day, the Istanbul Regional Migration Office decided to deport him and place him under administrative detention. On 31.12.2023, an appeal against the deportation decision was filed and submitted to the office. After being held in the Deportation Center for almost two months, he was released by the decision of the Istanbul 2nd Criminal Court of Peace.

Since the day of his release, he has been going to the Kumkapi Coordination Center every Monday and has fully fulfilled his obligation to sign. As a result of the lawsuit we filed against the deportation decision, Istanbul Administrative Court No. 15 has ANNULLED this decision. No documents or information were provided regarding the decision to reject the lawsuit, which is stated in the statement of the Migration Board, and we were unable to obtain this decision. The decision of the relevant court (Administrative Court No. 15) is attached.

If there had been a real deportation order, the respected teacher would have been arrested while fulfilling his weekly signature obligation. However, this was not the case. Instead, he was arrested in a raid on his home on May 8, 2025. He was taken to an unknown destination without informing his family and lawyers, and without even being allowed to take his medication or meet his personal needs. Eight days later, his family and lawyers have not been able to contact him. This situation is contrary to the law and human rights. There are allegations circulating among the public that he died in Uzbekistan, and this concern is growing.
