Consent is required for the recording and use of a person's image. In this case, consent is provided by the person's legal representative if the person is incapacitated, and by the person's heirs if the person has died and did not consent during his or her lifetime.
Also, according to the new draft law, children are defined as independent legal subjects when it comes to the recording and use of their personal images. In this case, consent on behalf of persons under the age of 16 is given by their parents (parental surrogates). From the age of 16, children make independent decisions in these relations.
In addition, the draft establishes requirements for ensuring privacy when implementing video surveillance. In this regard, if video surveillance systems are installed in buildings and structures, a warning sign will be required.
