Alabama Gov. Kay Ivey said Smith previously did not want the death penalty to be carried out by lethal injection. According to the governor, the method used during the execution was within the law.

In November 2022, they tried to execute Smith using the standard lethal injection method, but these attempts failed because they could not find a suitable vein in the prisoner to insert the needle.

Because of this, Smith became "the second prisoner in the United States to be executed in a second attempt."
