The procedure for monitoring persons under house arrest through an electronic bracelet was approved

According to it, starting from January 1, 2025, the procedure for real-time remote monitoring of the presence of persons subject to house arrest and the restriction of freedom sentence at the place of execution of the preventive measure and punishment will be gradually implemented.

An electronic bracelet is worn on the leg of a person who has been placed under house arrest or has been sentenced to restriction of liberty. In cases where it is not possible to wear an electronic bracelet on a person's leg (bone fracture, medical treatment for other injuries, etc.), it is allowed to wear it on the arm.

Regulation:

• the rights and obligations of persons designated to wear an electronic bracelet;

• liability for violation of the order of remote monitoring through an electronic bracelet;

• regulates relations related to procedures for recovery of material damage in case of damage or loss of an electronic bracelet.

A copy of the court's ruling on the application of a precautionary measure in the form of house arrest is sent to the "Electronic Bracelet" information system through the Electronic Criminal-Legal Statistics Information System.

Within one working day from the date of receipt of a copy of the court's decision, the executive staff will be determined in the "Electronic bracelet" information system based on a written order of the head of the district (city) internal affairs body.

The decision of the head of the probation department of the district (city) internal affairs body on the remote control of the person sentenced to the restriction of freedom through an electronic bracelet is formalized in the "Electronic bracelet" information system.

The electronic bracelet cannot be used by the following persons:

• Persons under the age of 18;

• pregnant women;

• Women with children under 3 years old;

• Persons with group I or II disabilities;

• people who are not recommended to wear an electronic bracelet according to medical instructions (people with an implanted cardiac pacemaker, people with an infectious skin disease (allergic contact dermatitis, skin fungus or itchy disease)).

Surname, first name, patronymic, gender, year of birth, personal identification number of an individual, time of wearing electronic bracelet, individual number of electronic bracelet, surname, first name, patronymic of executive staff and phone number are recorded in the "Electronic bracelet" information system.

When damage or failure of the electronic bracelet body is detected or when the electronic bracelet is lost, the executive staff immediately informs the head of the district (city) internal affairs body about it in writing.

Based on the written order of the head of the district (city) internal affairs body, an investigation will be conducted to study the reasons and conditions of damage, failure or loss of the electronic bracelet.

According to the inspection result:

• in case of damage or loss of an electronic bracelet by executive employees, financial liability measures will be applied to them;

• in cases where it is determined that a person who has been placed under house arrest or has been sentenced to a restriction of liberty has deliberately damaged an electronic bracelet, the material damage will be covered by this person.

The amount of material damage is determined in the inspection report. The conclusion of the investigation will be announced by receiving a receipt to the executive officers and the person who has been placed under the preventive measure of house arrest or sentenced to the restriction of liberty.

If the person who has been placed under house arrest or sentenced to restriction of liberty does not compensate the material damage within one month, this damage will be recovered by court procedure.

Earlier, it was reported that the methodology, electronic bracelet device and software for remote monitoring of persons sentenced to house arrest and restriction of freedom were developed at the Research Institute of Criminology.
